Over the years we have drafted hundreds of trusts of varied types and purposes. Given the relationships we develop with our clients, we are at times asked to serve as trustee. We take this responsibility very seriously and find it is a joy to work in this capacity as we carry out our clients’ wishes both during their lifetime and after.
As trustees, we have two primary responsibilities: 1) to exercise a duty of loyalty to administer the trust solely in the interest of the beneficiaries; and 2) to exercise reasonable care and skill in administering the trust. Practically, this requires us to
Carry out the trust donor’s intent,
Properly administer the trust,
Prepare trust accountings,
File the trust’s income tax returns,
Arrange for the custody of the trust assets, and
Hire and oversee the investment advisor responsible for the day-to-day investment management of the trust assets.
Unlike most corporate trustees, our fees are not based on a percentage of the trust assets. Instead, we charge only for the time we spend administering the trust.
