Guardianship and conservatorship are legal proceedings to obtain court-ordered appointments to authorize another person to make health-care and financial decisions for an incapacitated person or person in need of protective measures. While court intervention can be costly and time consuming, court intervention may become necessary for someone who has not done advance planning, when there are issues with power of attorney or health care proxy documents or when there are family disputes. Advance planning with tools like health care proxies, powers of attorney, and trusts can often eliminate the need to pursue guardianship or conservatorship.
