Massachusetts charitable immunity imposes a $20,000 limit on damages that can be awarded against a charitable corporation for any cause of action “based on tort.”
No matter how careful they might be, at some point every nonprofit will encounter disputes with other parties, whether they be customers, competitors, vendors or third-parties. Pathway Law prides itself on working with clients during the early stages of such disputes. Initially, we will evaluate the issue and the merits of each party’s claims and advise the client on its possible legal exposure. Based on this analysis, we work with the client to put together a strategy to resolve the dispute, often through negotiation with the opposing party. At this pre-litigation stage of dispute resolution, Pathway Law is frequently successful in resolving the dispute in a cost-effective manner. Should litigation ultimately be necessary, we will either work with our client’s litigation firm, or refer the matter to litigation specialists who we work with. In either event, we will stay involved to assist with the litigation according to the wishes of the client.
